Terms of Service

These Terms of Service ("Terms") are an agreement between you and The HORIZONs Co., Ltd. ("HORIZON SHIELD", "we", "us") for your use of the HORIZON SHIELD website and services for the United States (the "Service"). By using the Service you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

1. What the Service is

The Service has three parts: a free Quick Estimate, a Quote Check that compares the lines of one contractor quote you provide with U.S. public cost data, and a Detailed Estimate built from the measurements, photos and description you provide. Each returns a written report (the "Report"): reference values, their sources and formulas, questions you may ask, and a SHA-256 receipt. A Report is price benchmarking information for your own decisions.

We work only from what you send. We do not visit, measure or inspect your property. A Quick Estimate or Detailed Estimate is a cost reference, not a bid, not an offer to do or arrange the work, and not a promise of what any contractor will charge.

HORIZON SHIELD provides price benchmarking information only. We are not a licensed contractor, engineer, architect, home inspector, public adjuster, appraiser or attorney. We do not inspect property, assess its condition or code compliance, prepare or negotiate insurance claims, bid on, arrange or supervise work, or give legal advice.

Public-works figures, wage statistics, import statistics and permit records are not residential quotes. A difference between a quote line and a reference value does not mean that the quote is wrong or that the contractor acted improperly, and a match does not mean that the work or price is appropriate. You decide whether and with whom to contract.

2. Who may use it

You must be at least 18 years old and able to form a binding contract. You may upload a quote only if you received it or have the right to share it.

3. Your uploads

You keep all rights in what you upload. You give us a non-exclusive, worldwide, royalty-free license to store, process and reproduce it only to provide the Service to you, for as long as we keep it under our Privacy Policy. We will not use your upload or Report for any other purpose, including AI training, without your separate opt-in consent.

Do not upload material you have no right to share, or material that contains other people's sensitive information such as Social Security or account numbers. We may decline to process a file that appears to break these Terms.

4. Your Report

You may use, keep and share your Report, including with the contractor. Please do not remove the source list or the receipt when you share it, because they show where each number came from. We may publish statistics that combine many Reports only in a form that identifies no person, property or contractor.

5. Prices, payment and taxes

Prices are shown on the pricing page in U.S. dollars and include all fees we charge. Sales tax, where it applies, is shown before you pay. Payments are processed by PayPal, Inc. under its own terms; we do not receive your full card number. Plans are one-time purchases. There is no subscription or automatic renewal.

6. Cancellations and refunds

Our Refund Policy is part of these Terms. It includes a full refund if you cancel before we start, if we find no usable public data for your trade and ZIP code, if we deliver late, or if we cannot read your file.

7. Independence

For the Service, we receive no referral, lead, listing, advertising or success fees from contractors, suppliers or insurers, and we do not recommend, rank or introduce contractors. If this ever changes, we will say so on the page where it applies before it takes effect.

8. Acceptable use

Do not use the Service to break the law, to harass or defame anyone, including a contractor, to upload malware, to scrape or overload the Service, to reverse engineer it except as the law allows, or to present a Report as an inspection, appraisal, engineering opinion or legal opinion.

9. Our content and open data

The website and the Report format belong to us. The underlying U.S. dataset is published separately under the Creative Commons Attribution 4.0 license (USCCDB, doi:10.5281/zenodo.22979157), and public-domain source data remain public domain. Nothing in these Terms limits your right to post honest reviews of us.

10. Disclaimer of warranties

To the extent the law allows, the Service and Reports are provided "as is" and "as available". We do not warrant that a Report is complete or error free, that public data are current for your job, or that using a Report will save you money. Some states do not allow the exclusion of implied warranties, so some of this may not apply to you. Nothing in these Terms limits warranties or rights that the law of your state gives you and does not allow to be waived.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or savings, arising from the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or 100 U.S. dollars.

These limits do not apply to liability for fraud, willful misconduct or gross negligence, for personal injury caused by our negligence, or to any liability that the law does not allow to be limited.

12. Disputes and governing law

Talk to us first. Before filing a claim, email us a short description of the problem and what you want. We will try to resolve it within 30 days.

Governing law. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. This choice does not take away any protection that the law of the state where you live gives you and does not allow to be waived by contract.

Where claims are heard. You may bring a claim in the small claims court of the county where you live, or in the state or federal courts where you live. There is no arbitration requirement and no waiver of class actions in these Terms.

13. Copyright complaints

If you believe material on the Service infringes your copyright, send a notice under 17 U.S.C. 512(c)(3) to our designated agent: Toshikatsu Oga, The HORIZONs Co., Ltd., Win Aoyama 942, 2-2-15 Minami-Aoyama, Minato-ku, Tokyo 107-0062, Japan, contact@the-horizons-innovation.com, +81 463 74 5917. If your material was removed and you believe that was a mistake, you may send a counter notice under 17 U.S.C. 512(g)(3) to the same agent. We end access for users who repeatedly infringe.

14. Notice to California users

Under California Civil Code Section 1789.3, California users are entitled to this notice: the Service is provided by The HORIZONs Co., Ltd., Win Aoyama 942, 2-2-15 Minami-Aoyama, Minato-ku, Tokyo 107-0062, Japan, telephone +81 463 74 5917. Charges are as shown on the pricing page. You may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.

15. Changes and ending

We may change these Terms for future use by posting the new version with a new date. Changes do not apply to a purchase you already made. You may stop using the Service at any time. We may suspend access for a breach of these Terms, and will refund any paid Report we do not deliver.

16. General

If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may transfer them to a successor that continues the Service under them. These Terms, the Refund Policy and the Privacy Policy are the whole agreement between us about the Service.
